By downloading or using Calibrate, you agree to these Terms. If you don't agree, please don't use the App.
These Terms of Use ("Terms") constitute a legally binding agreement between you and Calibrate Within ("Developer," "we," "our," or "us") governing your use of the Calibrate mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.
Calibrate is a personal reflection and attention awareness application. The App allows you to:
Calibrate is not a medical device, therapeutic tool, or mental health treatment. It is a personal awareness tool and does not provide medical advice, diagnosis, or treatment of any kind.
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's consent to use the App.
All data you create within the App — including routines, reflections, notes, and session history — is stored locally on your device. You retain full ownership of your content. We do not access, collect, transmit, or store your content on any server.
You are solely responsible for maintaining backups of your data. Deleting the App will permanently remove all locally stored data.
Calibrate offers optional paid plans ("Calibrate Plus") that unlock additional features. By purchasing, you agree to the following terms:
Prices may vary by region and are displayed in your local currency in the App. Actual pricing is determined by the App Store at the time of purchase.
If a free trial is offered, it will be clearly indicated before purchase. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are limited to one per Apple ID.
If you reinstall the App or switch devices, you can restore your active subscription using the "Restore purchase" option in the App.

The App, including its design, code, graphics, logo, and content (excluding your user-generated content), is the property of Calibrate Within and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.
Our total liability to you for any claim arising from or relating to these Terms or your use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App or violation of these Terms.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. You may terminate your use of the App at any time by deleting it from your device.
The App uses Apple's StoreKit framework for subscription management. Your use of the App Store and any purchases made through it are governed by Apple's own Terms of Service and Privacy Policy. We are not responsible for Apple's services, policies, or actions.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in California.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of the App, and supersede all prior agreements and understandings.
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
